	FINKEROS.COM is a website designed for the exchange of information related to the purchase, sale and rental of fincas or rural properties, which involves not only exchanging information about such properties but also providing a means for sellers-agents to make themselves known directly and to manage both their information and their portfolio.	 
	Purpose of FINKEROS.COM	 
	FINKEROS.COM is a virtual platform or system developed through a website whose main purpose is the development of, and interaction among, users engaged in the purchase, sale and rental of fincas or rural properties, through the exchange of information relating to that real estate market.	 
	The information shared through the system consists mainly of the agent’s basic personal information, such as name, telephone number, address and any other information the user deems appropriate, as well as basic information about the fincas or rural properties offered, such as price, area, location, type of finca, climate, whether or not it has irrigation, whether or not it is residential, whether it has an area for crops and its size, in addition to the description of the property provided.	 
	FINKEROS.COM should be regarded as a web system or portal that helps locate the finca or rural property that best suits the user’s needs, enabling direct contact between client and agent.	 
	Therefore, the user of FINKEROS.COM, by accessing the system and accepting the platform’s terms and conditions, shall act solely toward the purposes of the website described above, as these are the object and purpose of the system.	 
	 
	TERMS OF SERVICE	 
	The Terms and Conditions of Service set out below govern access to and use of the services of FINKEROS.COM (the Services), of the websites directly related to it and under the administrator’s control, and of any other information, text, graphics, photos, images or other materials uploaded, downloaded or appearing on the Services (collectively, the “Content”).	 
	Access to and use of the FINKEROS.COM services are subject to prior acceptance of, and compliance with, the following Terms and Conditions of Service.	 
	It is reiterated that by merely accessing or using FINKEROS.COM, the user tacitly accepts the Terms and Conditions of Service and shall therefore be directly bound by them.	 
	Terms and Conditions of Service.	 
	The user shall be responsible for their use of the Services, for any content they publish on the Services and for the consequences of such publications.	 
	All content submitted, published or displayed may be viewed by users of the portal and of third-party websites where FINKEROS.COM has so authorized.	 
	The user may use the Services subject to these FINKEROS.COM Terms and Conditions, which apply by the mere access to and use of the Services of the website. In addition to being subject to the FINKEROS.COM Terms and Conditions, in using the Services the user shall be subject to the laws, regulations or rules applicable in the jurisdiction of domicile of the Administrator or FINKEROS.COM	 
	The applicable jurisdiction in the event of a legal dispute between the user, users or a third party and FINKEROS.COM shall be that of the Republic of Colombia.	 
	As the FINKEROS.COM Services evolve, their nature and form may change from time to time without prior notice. Likewise, FINKEROS.COM shall have full discretion to suspend or limit the provision of the Services, or any of them, temporarily or permanently, without prior notice to the user or group of users. 
	 
	FINKEROS.COM and third-party providers of FINKEROS.COM may use and display various advertising content through its main page in the different Services provided to users and in the Content, which users are deemed to accept by using the FINKEROS.COM services, subject to these FINKEROS.COM Terms and Conditions.	 
	Privacy.	 
	Information provided by the user of FINKEROS.COM is governed by the FINKEROS.COM Privacy Policy. By accepting the Terms and Conditions, or by merely using the FINKEROS.COM services, the user consents to the collection and use of all information provided, regardless of the user’s place of domicile, as well as to the transfer of information from or to the Republic of Colombia and any other country.	 
	All communications sent by FINKEROS.COM to users of the system shall form an integral part of the Service, and users may not be able to opt out of receiving them.	 
	Password.	 
	The user is obliged to safeguard and keep the password chosen to access the system, as it is their sole responsibility to keep it strictly confidential. FINKEROS.COM shall have no liability whatsoever for the loss of such password, nor for any damage or loss caused by third parties as a result of the user’s lack of diligence in safeguarding it. 
	 
	Content of the Services.	 
	The user shall bear responsibility for the content they disseminate, publicly or privately, on the portal.	 
	FINKEROS.COM shall not be responsible for the Content, of whatever type, issued by users on any of its Services, as such publication is at the user’s own account and risk. Likewise, FINKEROS.COM does not guarantee and is not responsible for the certainty, truthfulness, accuracy, falsehood or inaccuracy of the Content uploaded and published by its users, nor for any damage and/or loss it may cause.	 
	User Rights.	 
	By submitting, publishing or displaying any Content through the Services provided by FINKEROS.COM, the user grants FINKEROS.COM permission and a license, without any consideration in favor of the User, to publish, disseminate and share such Content through its own website and/or other media that need not have any relationship with FINKEROS.COM, always on the basis of the Terms and Conditions set out herein.	 
	By these Terms and Conditions, the user states and accepts that they hold all rights sufficient and necessary to grant the rights conferred over the information and Content uploaded and published through FINKEROS.COM.	 
	The user may use the software provided by FINKEROS.COM solely with and for the purposes for which it is intended, on the basis of the Terms and Conditions set out herein.	 
	Rights of FINKEROS.COM.	 
	Except for the Content provided by users, FINKEROS.COM shall own all rights in the Services it provides.	 
	The Services are protected by copyright, trademark and other laws of the Republic of Colombia and of other countries. The user may not at any time use the name, trademark, logo, domain name or any other distinctive feature of the brand without the prior authorization of FINKEROS.COM.	 
	 
	Restrictions on Content and Use of the Services.	 
	FINKEROS.COM shall have the power to delete, or not distribute, any Content within the Services offered to users whenever it deems it necessary to fully comply with the Terms and Conditions set out herein, or in order to comply with the Colombian legal system or that of another country.	 
	It may likewise delete and remove users who are deemed not to comply with the Terms and Conditions set out herein or with the laws, rules or regulations of the Colombian legal system or of another country.	 
	Neither the user nor third parties may manipulate the information offered by FINKEROS.COM or by users of the portal with a view to distorting the system, causing error or harm to users.	 
	Copyright Policy.	 
	FINKEROS.COM shall remain alert to any copyright infringement between users and FINKEROS.COM, among users, between third parties and users, and between third parties and FINKEROS.COM, and shall take the corresponding legal action to prevent or address the violations committed, in accordance with the laws, rules or regulations in force in the Colombian legal system and in other countries.	 
	If any infringement of copyright held by users of the system occurs, FINKEROS.COM asks that the administrator be informed of such infringement or violation, in order to determine its scope and take the corresponding legal measures.	 
	FINKEROS.COM may remove content that infringes the copyright of its users or its own copyright without prior notice, which may also result in the removal of the infringing account.	 
	Limitation of Liability for Certain Specific Services.	 
	·         Property information and location	 
	In accordance with the function and purpose of the FINKEROS.COM portal, it disclaims responsibility for the truthfulness of the information and location provided by users of the portal, as such information is at the user’s own account and risk, FINKEROS.COM being solely an administrator of the information for the purpose of making the various properties known among users.	 
	·         Personal Contact	 
	FINKEROS.COM shall not be responsible for personal relationships arising between users, whether through the system or by other means.	 
	All personal and contact information shared, personal interviews and private in-person meetings giving rise to any liability on the part of one or more users or third parties, at the properties or other physical locations, shall be the sole responsibility of the users and third parties, FINKEROS.COM remaining free of any civil or criminal liability for offenses or crimes committed among them, in accordance with the Colombian legal system or that of other countries.	 
	FINKEROS.COM disclaims any civil, contractual, non-contractual and criminal liability arising from such in-person meetings between users, the users being solely responsible for their contractual stipulations and the acts they carry out.	 
	·         Prohibition of USE by Minors.	 
	The use of FINKEROS.COM and the services provided by the WEBSITE is exclusively for persons who meet the legal age requirement under the laws of the Republic of Colombia. The minimum age shall be 18 years.	 
	Use of FINKEROS.COM and the services provided by the WEBSITE by MINORS shall be permitted only under the strict supervision of a responsible adult. FINKEROS.COM is not responsible for any damage or loss suffered by a minor in using the WEBSITE or any service derived from it.	 
	 
	·         Contractual Stipulations.	 
	FINKEROS.COM shall not be responsible for any contractual stipulation creating obligations between the parties-users, as it acts solely as Administrator of users’ information and remains outside the contracts, stipulations and relationships they may agree upon, whether inside or outside the FINKEROS.COM system	 
	 
	Links.	 
	The Services offered by FINKEROS.COM may contain links to third-party websites or resources, whether or not related to real estate activities.	 
	The user accepts that FINKEROS.COM shall not be responsible for the content of such links or websites, which it will seek to keep in line with the development and promotion of activities related to FINKEROS.COM; the user being solely responsible for their dealings and relationships with such third parties.	 
	Similarly, FINKEROS.COM is not responsible for the products or services offered by third parties in connection with real estate or related activities of FINKEROS.COM, nor for the fulfillment of commitments made between them and FINKEROS.COM users, as responsibility for and fulfillment of products and services rests solely and exclusively with the third-party provider.	 
	FINKEROS.COM disclaims any civil, contractual or non-contractual, and criminal liability that may arise between third-party website administrators and FINKEROS.COM users.	 
	·         Confidential and Personal Information	 
	FINKEROS.COM is not responsible for the loss of users’ personal information under any circumstances.	 
	Likewise, FINKEROS.COM disclaims any civil, contractual and non-contractual, and criminal liability for damage and/or loss resulting from the use of information obtained fraudulently, deceptively or stolen by third parties from the databases and/or any medium containing information administered or handled by the Administrator.	 
	Subscription to FINKEROS.COM Services	 
	·         Subscription.	 
	A person may acquire the services offered by FINKEROS.COM through a subscription in their name via the WEBSITE: FINKEROS.COM.	 
	·         Payment Method.	 
	The Subscriber may pay for their subscription using the payment method available at the time of subscribing.	 
	FINKEROS.COM reserves the right to add other payment methods and/or remove any of them whenever it deems appropriate.	 
	If the Subscriber fails to pay for the service acquired, FINKEROS.COM may collect the corresponding amount through the appropriate enforcement proceedings and report the person who authorized the purchase to credit bureaus, regardless of the Subscriber’s place of origin.	 
	·         Prices and Rates.	 
	The price the Subscriber has agreed to pay for the subscription service acquired is the “Rate” in effect at the time of the request.	 
	FINKEROS.COM reserves the right to change its “Rates” according to market or product conditions.	 
	Applicable Jurisdiction.	 
	In the event of any dispute between FINKEROS.COM and users or third parties accessing the system, the applicable jurisdiction shall be that set out in the legal system of the Republic of Colombia.	 
	Acceptance of Terms and Conditions.	
	Acceptance of the foregoing Terms and Conditions of Service entails full submission to them, binding the user to comply with them.
